No ID theory in Penn classes

Here is a definite blow to the ID proponents: Judge John E. Jones in Pennsylvania says no to teaching ID theory in classes. New Scientist has a good story to tell. And please also read the words by Judge John E. Jones himself!

God Bless the 1st Ammendment, and the judges with the wisdom to appreciate its intent.

What happens in private schools, where the establishment clause is less of an issue? Does wisdom prevail at an earlier stage, or are they becoming less friendly to legitimate science?
